Information on the processing of personal data

In connection with the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of personal data of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation hereinafter referred to as the Regulation) Drzewiecki Tomaszek i Wspólnicy Office in Krakow informs about the principles of personal data processing:

I. Data controller

Krakow Office of the Law Firm Drzewiecki, Tomaszek i Wspólnicy sp. j. with its registered office in Warsaw, 23 Belwederska Street, 00-761 Warsaw, KRS number 0000297875 is conducted by DT Krakow Golenia Wojtyczek Adwokaci sp. p. with its registered office in Krakow, 2/6 Brodowicza Street, 31-518 Krakow, KRS number 0000804684 hereinafter referred to as the "Law Firm". The Law Firm carries out the processing of your personal data.

Contact with the Law Firm as the controller

The Law Firm has not designated the Data Protection Officer. In matters related to the protection of personal data, you can contact the Law Firm directly by e-mail to biuro@dtkrakow.com.pl or in writing to the registered address of the Law Firm.

III. Categories of personal data

This information concerns the processing of both personal data obtained from the data subjects and personal data obtained in a different manner than from the data subject. The Law Firm process the following categories of data in particular: identification data, address data and contact details. In connection with the provision of services to the Clients of the Law Firm and participation in the process of administration of justice by courts, the Law Firm may also process other personal data, including, where justified, specific categories of personal data referred to in Article 9(1) of the Regulation.

IV. Purposes and legal basis for the processing of personal data

Personal data may be processed by the Law Firm for the following purposes:

  1. the establishment, exercise or defence of claims (the legal basis for the processing of personal data in this respect is a legitimate interest pursued by the Law Firm, i.e. Article 6(1) point (f) of the Regulation);
  2. performance of a contract to which the data subject is a party or to take action at the request of the data subject (the legal basis for the processing of personal data in this respect is Article 6(1) point (b) of the Regulation);
  3. exercise legal claims on behalf of the Clients of the Law Firm and undertake other activities for the Clients of the Law Firm, including for the purposes resulting from the need to protect vital interests of the Clients of the Law Firm, as well as the necessity to fulfil legal obligations incumbent on the Law Firm, and to pursue legitimate interests of the Law Firm (the legal basis for the processing of personal data in this respect is Article 6(1) point (d), Article 6(1) point (c) and Article 6(1) point (f) of the Regulation respectively);
  4. for archiving (evidence-related) purposes, pursuing our legitimate interest to secure information in case of a legal need to prove facts (the legal basis for the processing of personal data in this respect is Article 6(1) point (f) of the Regulation);
  5. 5. recruitment of persons interested in working for or cooperating with the Law Firm (the legal basis for the processing of personal data in this respect is, Article 6(1) point (c) and Article 6(1) point (a) of the Regulation respectively).

The processing by the Law Firm of the special categories of personal data referred to in Article 9(1) of the Regulation is only possible in order to establish, pursue or defend claims or in the context of administration of justice by courts (the legal basis for the processing of personal data in this respect is Article 9(2) point (f) of the Regulation).

V. Information on periods of personal data processing

The Law Firm will store your personal data:

  1. in connection with the conclusion of the contract and for the purpose of its performance – throughout the term of the contract, and then for the period and to the extent required by law, as well as for the period necessary to establish, pursue and defend claims, or cancel an entry of sentence;
  2. as regards establishing, pursuing or defence of claims – until potential claims resulting from the agreement or under other arrangements become statute-barred;
  3. in order to fulfil legal obligations incumbent on the Law Firm – for the legally required period of documentation storage and fulfilment of obligations towards you resulting therefrom.

  

VI. Information on recipients of personal data

The data are intended for the Law Firm and may be transferred to the following recipients:

  1. entities and bodies to which the Law Firm is obliged or authorised to make personal data available based on generally applicable laws;
  2. entities processing personal data of the data subject on behalf of the Law Firm based on a contract concluded with the Law Firm on entrusting the processing of personal data.

 

VII. Information on automated processing of personal data

No automated decision-making takes place in connection with your personal data. The Law Firm does not use profiling.

VIII. Rights of the data subject

You have the right to access your personal data, the right to request their rectification and erasure, the right of data portability, and the right to limit the processing in accordance with the Regulation. To the extent that the basis for the processing of your personal data is a legitimate interest of the Law Firm, you have the right to object to the processing of your personal data. You also have the right to lodge a complaint with an authority responsible for supervising compliance with the Regulation (i.e. the President of the Office for the Protection of Personal Data) where there is a suspicion that the processing of your personal data violates the personal data protection legislation.

IX. IX. Source of data

The personal data processed by the Law Firm are obtained from the Clients of the Law Firm and its contractors, from third parties in the course of services rendered by the Law Firm, as well as from publicly available sources (e.g. databases and registers: REGON, Central Register and Information on Economic Activity (CEIDG), and the National Court Register.

I. What do we use cookies for?

We can use cookies, for example, to: adjust the website content to user preferences and optimise the use of websites. Cookies are also used to create anonymous, aggregated statistics that help understand how the user uses websites, which makes it possible to improve their functionality. When using cookies in the manner describe above, we never identify users based on cookie-stored information.

II. How long are cookies stored?

Two types of cookies are used: “session” cookies and “permanent” cookies. The first are temporary files that remain on the user’s device until they log out, leave the website or disable the software (web browser). “Permanent” files are stored on the user’s device for a period specified in cookie settings or until they are removed by the user. III. Can I opt out of accepting cookies?
