Pursuant to the Act of 18 November 2020 on electronic delivery (Journal of Laws 2024, item 1045, i.e.), entrepreneurs entered in the National Court Register (KRS) before 1 January 2025 are required to have an address for e-delivery from 1 April 2025. In case you have not yet done so, we recommend that you take immediate steps to obtain an address.
What should be done?
1. set up an e-grant address by submitting an application in the system available at gov.pl (https://www.gov.pl/web/rozwoj-technologia/e-doreczenia-dla-przedsiebiorcow)
2. ensure that the address is entered in the Database of Electronic Addresses (BAE):
- once an application has been submitted, an acknowledgement of receipt will be sent (in the form of an e-mail or a message in the gov.pl system);
- if the application has been submitted correctly, the address automatically goes into the BAE and KRS.
New companies, registered in the KRS after 1 January 2025, must indicate an address for e-collateralisation already during the application for entry in the KRS Register of Entrepreneurs. It may also be necessary to provide a postal address for e-credentials when applying for entry of changes in the KRS Register of Entrepreneurs.
Changes also await entrepreneurs entered in CEIDG, i.e. so-called sole proprietorships; for them, it will be mandatory to have an e-address from 10 October 2026.
It is the legislator's intention that e-delivery will become the main way of communicating with the authorities, and the absence of an active address can have serious legal consequences in terms of missed deadlines for taking action on one's affairs.
