Today, the Municipality of Krakow purchased the so-called Park Jalu Kurek. Our law firm represented Polish Province of Salvatorian Fathers in this transaction. It is a property with an area of over 1.6 ha, located at Szlak Street in the very center of Krakow.
The subject of the transaction is a historic park existing since the 17th century, which is part of the palace-park magnate residence, which was the so-called The Montelupich Palace and its surrounding gardens.
The property has gone through a complex fortune. You can read about its history in various historical studies about Krakow. In 1948, the Salvatorian Fathers bought the park from the then owners - the heirs of Count Hieronim Tarnowski. Already in 1951, the park was taken over by the State Treasury by the communist authorities in the course of the so-called the act on the takeover by the state of the property of the dead hand. It was not until 2003 that our client regained the ownership of most of this illegally taken land.
The purchase of the property by the Municipality will make the park available to the inhabitants of Krakow.

In the Court of Appeal in Kraków, a lawsuit is still pending for compensation for a small part of the park, which was also unlawfully taken over in 1951, and which was managed in a different way during the People's Republic of Poland. In this case, by a non-final judgment of December 22, 2021, the District Court in Krakow upheld the claim of the Province and awarded compensation to our client from the State Treasury.
